Chauvin and other agents face federal charges over George Floyd’s death – Deadline

A federal grand jury indicted Derek Chauvin and three other former Minneapolis police officers on civil rights charges in the death of George Floyd.

Chauvin, 45, and Tou Thao, 35; J. Alexander Kueng, 27 years old; and Thomas Lane, 38, were charged in an indictment with three counts of willfully depriving Floyd of his constitutional rights.

Chauvin was convicted last month of second degree murder, third degree murder and second degree manslaughter. His conviction is scheduled for June, but his lawyers are asking for a new trial.

The federal grand jury also indicted Chauvin for willfully depriving a minor of the constitutional right not to use unreasonable force by a police officer. It has to do with an incident on September 4, 2017, in which Chauvin allegedly held a teenager by the throat and hit him several times on the head with a flashlight.

The jury at Chauvin’s recent trial did not hear about the 2017 incident, which was detailed in a file from last year by Matthew Frank, Assistant Attorney General of Minnesota.

The DOJ is also conducting a civilian investigation into the Minneapolis Police Department and the City of Minneapolis for its law enforcement practices.

Thao, Kueng, and Lane also face a trial on state charges for their role in Floyd’s death.

The federal indictment relating to Floyd’s death on May 25 – read it here – includes three counts. Chauvin allegedly held his knee to Floyd’s neck and his right knee to his back and arm, while Floyd “lay on the ground, handcuffed and without resistance”. The indictment alleges that Chauvin “kept his knees on Mr. Floyd’s neck and body even after Mr. Floyd became unresponsive.

“This offense resulted in bodily injury and death of George Floyd,” the indictment reads.

Chauvin’s lawyers argued in his recent trial that other factors led to Floyd’s death, including heart disease, and that Chauvin’s use of force was justified given his previous resistance to it. ‘arrest.

Another count alleges that Kueng and Thao “willfully failed to intervene to prevent defendant Chauvin from using unreasonable force.” The third count claims that the four agents “willfully failed to assist Floyd, thereby acting with willful indifference in the face of substantial risk of harm to Floyd.”
